Article 1 – Scope of application

These terms and conditions of sale apply to products sold on the www.contesdessines.com website to the exclusion of all others, in particular those governing in-store sales.

This contract defines the general terms and conditions of sale (hereinafter referred to as “GTCS”) applicable to all sales of children’s books by the publisher (hereinafter referred to as “the publisher”) to its customers (hereinafter referred to as “the customers”).
The GTC are expressly accepted by the customer at the time of the order. They prevail over any other general or special conditions not expressly approved by the publisher.
The books offered for sale are those listed in the publisher’s online catalog. The publisher reserves the right to modify the content of its catalog at any time.
Book sales prices are indicated in euros, inclusive of all taxes, and do not include delivery charges, which are invoiced in addition. Delivery costs depend on the delivery method chosen by the customer and the weight of the package.
Books are payable in full at the time of order. The publisher accepts payment by credit card, bank transfer and cheque.
Books are delivered to the delivery address indicated by the customer at the time of ordering. The publisher cannot be held responsible for delivery delays caused by carriers.
In the event of damaged delivery, the customer must refuse the parcel and inform the publisher as soon as possible. In the event of non-delivery or non-conformity of the books delivered, the customer must inform the publisher as soon as possible.
Books are guaranteed against all hidden defects for a period of 6 months from the date of delivery. In the event of non-conformity, the customer may choose between repair and replacement of the book, subject to the conditions laid down by law.
The right of withdrawal does not apply to personalized or made-to-measure books.
In the event of a dispute, the parties agree to seek an amicable solution before taking any legal action. Failing amicable settlement, the dispute will be referred to the competent courts.

Article 2 – Orders

Orders are placed on the www.contesdessines.com website. Contractual information, written in French, will appear on the order confirmation document.

Validation of your order implies full acceptance of these conditions of sale.

ContesDessines.com reserves the right to refuse an order from a customer with whom there is a dispute concerning the payment of a previous order.

In accordance with article L221-5 of the French Consumer Code, the customer has a period of fourteen working days in which to exercise his or her right of withdrawal, without having to provide any justification or incur any penalties. The customer is then reimbursed (with the exception of the cost of returning the product, which remains at the customer’s expense).

Return shipping costs are at the customer’s expense. Reimbursement will be made after the goods have been recovered, subject to their being in good condition, by credit card (where possible) or by bank transfer.

Article 3 – Availability

ContesDessines.com cannot guarantee the availability of the entire online catalog. You will find information on availability on the pages corresponding to the books you have chosen.

We do not have the entire catalog in stock. The information on this site is subject to availability and print-on-demand. You will receive an e-mail indicating the delivery time and, in the event of unavailability, your order will be immediately cancelled and reimbursed if necessary.

ContesDessines.com undertakes to refund any order that cannot be served, but cannot pay any compensation in this respect.

Pre-order books: The titles offered on this site are dispatched as soon as they go on sale. ContesDessines.com cannot be held responsible for any delay in the date of sale.

Article 4 – Prices

Our prices are indicated in euros, all taxes included (excluding preparation and shipping costs, which depend on the shipping zone and are calculated before order confirmation).

Books are sold in strict compliance with legislation on book prices, and in particular with Loi Lang 81-766 du 10 août 1981 sur le prix unique du livre, which stipulates that the publisher sets the price of the book.

Prices may be updated at any time without notice, but items are invoiced on the basis of the current price displayed when the order is placed.

Article 5 – Shipping costs

Shipping costs are calculated as accurately as possible according to your delivery address and the total weight of the books in your order. You can get an estimate by creating a basket with the books you are interested in.

Article 6 – Payment

Orders are invoiced and payable in euros by ContesDessines.com.

When you pay by credit card, the amount of the goods shipped will be debited as far as possible each time a parcel is sent.

In the case of payment by e-card or virtual credit card, or in the case of a credit card that expires less than 2 months plus the current month after the order date, the price is payable in full in a single instalment on the order date.

Any customs duties or local taxes for deliveries outside mainland France are the responsibility of the recipient, who is then the importer. For shipments outside the European Union and French overseas departments and territories, the price will automatically be calculated exclusive of tax on the invoice.

Products delivered and invoiced remain the property of ContesDessines.com until full payment of the price.

Payment can be made by credit card (Visa, Eurocard, Mastercard), Paypal or international bank transfer.

In the case of cheques or bank transfers, delivery takes place as soon as the transfer is received.

Article 7 – Payment security

Payment by credit card on the ContesDessines.com site is entirely secure and encrypted by our bank. Sensitive information transmitted at the time of payment is subject to SSL encryption.

Article 8 – Delivery

ContesDessines.com, as part of its sales contract, takes full responsibility for the delivery and transport of the books to the address indicated at the time of the order, the inherent costs being incidental to these operations.

The risk of loss or destruction is borne by the purchaser upon delivery. He/she shall personally bear any insurance costs.

The delivery time includes the time required to prepare the parcel, plus the time required for delivery. The “Delivery times” section shows you how to calculate your delivery time.

In the event of a delay in shipment, you will be notified by e-mail. In this case, as long as the product has not been dispatched, you can cancel your order.

Note: orders paid by cheque will only be processed on receipt of payment.

Orders not served within 30 days will be cancelled unless otherwise specified.

Some countries restrict the entry of goods. It is the buyer’s responsibility to check the conditions of access to the goods in the country of destination.

ContesDessines.com cannot be held responsible for any destruction or blockage of the package upon entry into the destination country.

Article 9 – Delivery times

Deliveries are made from Monday to Saturday inclusive (except on public holidays).

Orders received before noon are processed the same day.

The delivery times given are average delivery times. In case of unavailability, shipment may be delayed. Please allow for the delay corresponding to the longest item in your order.

Article 10 – Legal warranty of conformity

“ContesDessines.com – BNC Xavier Dutertre Copyright-X” is liable for defects in conformity in accordance with Articles L. 211-4 et seq. of the French Consumer Code, and Articles 1641 et seq. of the French Civil Code.

You have two years from delivery to take action, can choose between repair or replacement (subject to conditions), and are exempt from proving the existence of the defect for 24 months (new goods).

This warranty applies independently of any commercial warranty.

You can also invoke the warranty against hidden defects under article 1641 of the French Civil Code, and ask for the sale to be rescinded or for the price to be reduced in accordance with article 1644.

Consumer and Civil Code :
– L217-4: the seller is responsible for defects in conformity.
– L217-5: the good must correspond to the contract.
– L217-12: action possible 2 years after delivery.
– L217-16: warranty extension in case of repair.
– 1641 & 1648 al.1: action possible 2 years after discovery of defect.

Article 11 – Disputes

In the event of a dispute, French law will apply.

According to articles L 611-1 and R 612-1 of the French Consumer Code: if no amicable solution is found within 2 months, you may refer the matter to a mediator free of charge within one year of your initial complaint.

We collect personal information necessary to process orders.

In accordance with the French Data Protection Act of January 6, 1978, you have the right to access, rectify and delete your personal data.
