Article 1 – Scope of Application
These general terms and conditions of sale apply to products sold on the site www.contesdessines.com, to the exclusion of all others, in particular those governing in-store sales.

- This contract defines the general terms and conditions of sale (hereinafter referred to as “T&Cs”) applicable to all sales of children’s books by the publisher (hereinafter referred to as “the publisher”) to its customers (hereinafter referred to as “the customers”).
- The T&Cs are expressly accepted by the customer at the time of order. They prevail over any other general or special conditions not expressly approved by the publisher.
- The books offered for sale are those listed in the publisher’s online catalog. The publisher reserves the right to modify the contents of its catalog at any time.
- The sale prices of the books are shown in euros, inclusive of all taxes, and do not include delivery charges, which are billed separately. Delivery charges depend on the delivery method chosen by the customer and the weight of the parcel.
- The books are payable in full at the time of order. The publisher accepts payment by bank card, bank transfer, and check.
- The books are delivered to the delivery address indicated by the customer when ordering. The publisher cannot be held responsible for delivery delays caused by carriers.
- In the event of damaged delivery, the customer must refuse the parcel and inform the publisher as soon as possible. In the event of non-delivery or non-conformity of the delivered books, the customer must inform the publisher as soon as possible.
- The books are guaranteed against any hidden defects for a period of 6 months from the date of delivery. In the event of non-conformity, the customer may choose between repair and replacement of the book, subject to the conditions laid down by law.
- The right of withdrawal does not apply to personalized or made-to-measure books.
- In the event of a dispute, the parties undertake to seek an amicable solution before any legal action. Failing amicable agreement, the dispute will be brought before the competent courts.
Article 2 – Orders
Orders are placed on the site www.contesdessines.com. The contractual information, written in French, will appear on the order confirmation document.
Validation of your order implies full and complete acceptance of these terms of sale.
ContesDessines.com reserves the right to refuse an order from a customer with whom there is a dispute relating to payment for a previous order.
In accordance with Article L221-5 of the French Consumer Code, the customer has a period of fourteen working days to exercise the right of withdrawal, without having to provide justification or incur penalties. The customer is then refunded (with the exception of return shipping costs, which remain at their expense).
Return shipping costs are the responsibility of the customer. Refunds will be made after the goods are recovered, subject to their being in good condition, by bank card (when possible) or by bank transfer.
Article 3 – Availability
ContesDessines.com cannot guarantee the availability of the entire online catalog. You will find availability information on the pages corresponding to the books you have chosen.
We do not keep the entire catalog in stock. The information on this site is subject to availability and print-on-demand. You will receive an e-mail indicating the delivery time and, in the event of unavailability, your order will be immediately canceled and refunded if necessary.
ContesDessines.com undertakes to refund any order that cannot be fulfilled, but cannot pay any compensation for this reason.
Pre-order books: Titles offered on this site are shipped as soon as they go on sale. ContesDessines.com cannot be held responsible for any delay in the release date.
Article 4 – Prices
Our prices are shown in euros, inclusive of all taxes (excluding preparation and shipping costs, which depend on the shipping zone and are calculated before order confirmation).
The books are sold in strict compliance with book price legislation, and in particular with the Lang Law 81-766 of August 10, 1981 on the fixed price of books, which states that the publisher sets the book price.
Prices may be updated at any time without notice, but items are billed on the basis of the current price displayed at the time the order is placed.
Article 5 – Shipping Costs
Shipping costs are calculated as accurately as possible based on your delivery address and the total weight of the books in your order. You can get an estimate by creating a cart with the books you are interested in.
Article 6 – Payment
Orders are invoiced and payable in euros by ContesDessines.com.
When you pay by bank card, the amount for the goods shipped will be debited as much as possible with each parcel shipment.
In the case of payment by e-card or virtual bank card, or in the case of a bank card expiring less than 2 months plus the current month after the order date, the price is payable in full in a single payment on the order date.
Any customs duties or local taxes for deliveries outside mainland France are the responsibility of the recipient, who then becomes the importer. For shipments outside the European Union and the French overseas departments and territories, the price will automatically be calculated excluding taxes on the invoice.
The delivered and invoiced products remain the property of ContesDessines.com until full payment of the price.
Payment can be made by bank card (Visa, Eurocard, Mastercard), Paypal or international bank transfer.
In the case of checks or bank transfers, delivery takes place upon receipt of payment.
Article 7 – Payment Security
Payment by bank card on the ContesDessines.com site is fully secure and encrypted by our bank. Sensitive information transmitted at the time of payment is subject to SSL encryption.
Article 8 – Delivery
ContesDessines.com, as part of its sales contract, takes full responsibility for the delivery and transport of the books to the address indicated when ordering, with any related costs being ancillary to these operations.
The risk of loss or destruction is borne by the buyer upon delivery. The buyer personally bears any insurance costs.
The delivery time includes the time needed to prepare the parcel, plus the time needed for delivery. The “Delivery Times” section tells you how to calculate your delivery time.
In the event of shipping delays, you will be notified by e-mail. In this case, as long as the product has not been shipped, you may cancel your order.
Note: orders paid by check will only be processed upon receipt of payment.
Orders not fulfilled within 30 days will be canceled unless otherwise stated.
Some countries restrict the import of goods. It is the buyer’s responsibility to check the import conditions for goods in the destination country.
ContesDessines.com cannot be held responsible for any destruction or blockage of the parcel upon entry into the destination country.
Article 9 – Delivery Times
Deliveries are made from Monday to Saturday inclusive (excluding public holidays).
Orders received before noon are processed the same day.
The delivery times indicated are average times. In the event of unavailability, shipping may be delayed. Please allow for the delay corresponding to the longest item in your order.

Article 10 – Legal Guarantee of Conformity
“ContesDessines.com – BNC Xavier Dutertre Copyright-X” is responsible for conformity defects in accordance with Articles L. 211-4 and following of the French Consumer Code, and Articles 1641 and following of the French Civil Code.
You have two years from delivery to take action, may choose between repair or replacement (subject to conditions), and are exempt from proving the existence of the defect for 24 months (new goods).
This guarantee applies independently of any commercial guarantee.
You may also invoke the warranty against hidden defects provided for in Article 1641 of the French Civil Code, and request either rescission of the sale or a reduction in price in accordance with Article 1644.
Consumer Code and Civil Code:
– L217-4: the seller is responsible for conformity defects.
– L217-5: the goods must conform to the contract.
– L217-12: action possible 2 years after delivery.
– L217-16: guarantee extension in the event of repair.
– 1641 & 1648 para. 1: action possible 2 years after discovery of the defect.
Article 11 – Disputes
In the event of a dispute, French law will apply.
According to Articles L 611-1 and R 612-1 of the French Consumer Code: if no amicable solution is found within 2 months, you may refer the matter free of charge to a mediator within one year from your initial complaint.
We collect the personal information necessary to process orders.
In accordance with the French Data Protection Act of January 6, 1978, you have the right to access, rectify, and delete your personal data.
